1. Seller Identification
This document sets forth the Terms and Conditions applicable to the use of the website www.docnutry.com and to purchases made on it.

For the purposes of these Terms and Conditions, the terms “DocNutry, ” “we,” or “seller” refer to Enigma Exímio, Lda., and the terms “Customer” or “consumer” refer to the person who uses the website or places an order.
2. Purpose and Scope of Application
2.1. These Terms and Conditions govern access to the website, the use of its content, and the purchase of products through the DocNutry online store.
2.2. By placing an order, the Customer acknowledges that they have read and accepted these Terms and Conditions, as well as the other policies available on the website.
2.3. DocNutry may update these Terms and Conditions as needed. Changes take effect upon publication and apply to orders placed thereafter. The version in effect at the time an order is completed will apply to that order.
3. Products and Sales Information
3.1. DocNutry strives to provide clear and up-to-date descriptions, ingredient lists, images, prices, and other product information.
3.2. The images are for illustrative purposes only. The packaging, presentation, color, or other visual elements may be changed by the manufacturer without prior notice. Before use, the Customer must verify the information on the packaging and label of the product received.
3.3. If you have any questions about a product’s features, please contact DocNutry before completing your purchase.
3.4. Dietary supplements are not a substitute for a varied and balanced diet or a healthy lifestyle. The customer must follow the manufacturer’s recommendations for use and warnings. If you are ill, pregnant, breastfeeding, taking medication, or have any doubts about whether a product is right for you, you should seek advice from a healthcare professional.
4. Order Fulfillment
4.1. To make a purchase, the Customer must select the products, add them to the cart, provide the necessary billing and shipping information, choose the shipping and payment methods, and confirm the order.
4.2. The Customer is responsible for providing complete, accurate, and up-to-date information, including their name, tax ID number, email address, phone number, and billing and shipping addresses.
4.3. Once the purchase is complete, you will receive an automatic email with an order summary. This message confirms receipt of your order, but does not guarantee the availability of all products.
4.4. The order is considered accepted after payment and product availability have been confirmed.
4.5. The Customer must verify the order details and report any errors as soon as possible. Once the order has been shipped, it may no longer be possible to change or cancel it.
5. Product Availability
5.1. All orders are subject to product availability.
5.2. If a product becomes unavailable after an order has been placed, DocNutry will notify the Customer and, when possible, offer an alternative. The Customer may accept the replacement or request a refund for the amount paid for the unavailable product.
5.3. DocNutry may make partial deliveries when doing so helps avoid a significant delay, provided it notifies the Customer in advance and does not charge the Customer additional shipping fees for such a split delivery.
5.4. DocNutry may refuse or cancel an order when:
- If payment is not confirmed by the specified deadline;
- The information provided is incomplete, incorrect, or cannot be verified;
- The product is out of stock;
- There is a clear error in the price or description;
- Delivery cannot be made to the specified destination;
- There is substantial evidence of fraud, misuse, or unauthorized resale.
When a paid order is canceled by DocNutry, the corresponding amount will be refunded via the payment method used, unless this is technically impossible or there is an express agreement to the contrary.
6. Prices and Promotions
6.1. The prices listed on the website are in euros and include VAT at the applicable statutory rate, unless otherwise specified.
6.2. Shipping costs, any collection fees, and other applicable charges are displayed before the order is confirmed.
6.3. In the event of an obvious pricing error, DocNutry will notify the Customer before shipment. The Customer may confirm the purchase at the correct price or cancel the order and receive a full refund of the amount paid.
6.4. Promotions are valid during the advertised period and are subject to the specific terms of the campaign and stock availability.
6.5. If you return a product purchased at a discount, the refund will be equal to the amount you actually paid for that product. For bundles, associated offers, or quantity-based promotions, a return may result in a recalculation of the promotional benefit, in accordance with the advertised terms and conditions.
7. Payment Methods
7.1. The available payment methods are displayed at checkout and may include:
- Credit or debit card;
- ATM Reference;
- MB WAY;
- Bank transfer;
- Cash on delivery, in destinations where this option is available;
- Other methods identified at checkout.
7.2. Order fulfillment begins after payment is confirmed, except for cash-on-delivery payments.
7.3. For bank transfers, the Customer must include the order reference number. If payment is not received by the deadline indicated at checkout or in the order confirmation, the order may be canceled.
7.4. Electronic payments are processed by specialized service providers. DocNutry does not have access to the full details of the card used by the customer.
8. Shipping and Delivery
8.1. Orders are shipped via DPD to the destinations available at checkout.
8.2. Information on costs, shipping methods, covered destinations, minimum order amounts for free shipping, and estimated delivery times can be found on the Shipping and Payments page, which forms part of these Terms and Conditions.
8.3. Delivery times are estimates and begin after shipment. They are subject to change during promotional periods, holidays, stock shortages, force majeure events, or customs procedures.
8.4. The customer will receive a tracking code, when available, to track the delivery.
8.5. The order is considered delivered when the Customer, or a third party designated by the Customer other than the carrier, takes physical possession of the products.
8.6. The Customer must ensure that the address is correct and that someone is available to receive the package. If delivery fails due to an incorrect address, absence, unjustified refusal, or failure to pick up the package, the actual costs of return shipping and reshipment may be charged, provided that the Customer has been notified in advance.
8.7. If the packaging shows visible damage, the Customer should, whenever possible, report the issue to the courier and take a photo of the packaging. This recommendation does not limit the consumer’s legal rights regarding damaged or missing products.
8.8. For shipments outside the European Union, customs duties, taxes, or other charges may be imposed by the authorities of the destination country. Unless otherwise specified, these charges are the responsibility of the recipient.
9. Order Cancellation
9.1. The Customer may request a cancellation using the contact information provided on the website.
9.2. If the order has not yet been shipped, DocNutry will attempt to cancel the shipment and will refund the amount paid via the same payment method, at no cost to the Customer, unless this is technically impossible or an express agreement to the contrary has been made.
9.3. If the order has already been shipped, the rules regarding the right of withdrawal and the Exchange and Return Policy apply.
10. No-questions-asked returns, exchanges, and refunds
10.1. In distance sales, consumers generally have 14 calendar days to exercise their right of withdrawal without having to provide any reason, in accordance with applicable law.
10.2. The conditions, procedure, return costs, legal exclusions, and refund deadlines are detailed on the Exchanges and Returns page, which is incorporated into these Terms and Conditions.
10.3. The right of withdrawal does not apply, among other cases provided for by law, to products that are likely to deteriorate rapidly and to sealed products that, for health or hygiene reasons, cannot be returned once opened.
10.4. The fact that a product is a dietary supplement, food, cosmetic, or personal care item does not, in and of itself, automatically preclude a return. The possibility of a return depends on the product’s characteristics, the condition of the packaging, the presence of a tamper-evident seal, and any legally applicable exclusions.
10.5. In the event of a valid cancellation, the refund will be issued at no cost to the Customer via the same payment method used for the purchase, unless otherwise expressly agreed. DocNutry may withhold the refund until it receives the returned products or until the Customer provides proof of shipment, whichever occurs first.
11. Noncompliance and Legal Warranty
11.1. DocNutry is liable for any nonconformities that exist at the time of delivery and that become apparent within the applicable legal time limit.
11.2. For new movable property, the statutory period of liability is, as a general rule, three years from the date of delivery, without prejudice to the specific provisions set forth in the law and the nature or shelf life of the product.
11.3. In the event of nonconformity, the consumer may be entitled to have the nonconformity remedied through repair or replacement, to a proportional price reduction, or to terminate the contract, in accordance with the requirements and the order of rights set forth in the applicable legislation.
11.4. The product must be brought back into compliance free of charge, within a reasonable time, and without causing significant inconvenience to the consumer.
11.5. To report a damaged, incorrect, or non-compliant product, the Customer must contact DocNutry, providing the order number, a description of the problem, and, whenever possible, photographs of the product and the packaging.
12. Use of the Website
12.1. The Customer agrees to use the website in a lawful manner, not to provide false identification, and not to engage in any actions that could compromise the security, availability, or operation of the store.
12.2. When creating an account, the Customer is responsible for keeping their credentials confidential and for reporting any unauthorized use.
12.3. The content, trademarks, logos, images, text, and graphic elements on this website are protected by intellectual property rights and may not be reproduced or used without authorization, except as permitted by law.
13. Liability
13.1. DocNutry is not liable for any damages resulting from the use of products in a manner inconsistent with the manufacturer’s instructions, warnings, or intended use.
13.2. Nothing in these Terms and Conditions excludes or limits the consumer’s mandatory rights or any liability that cannot be legally excluded.
13.3. DocNutry shall not be liable for delays or failures to perform caused by events beyond its reasonable control, without prejudice to the consumer’s rights under the law.
13.4. For international shipments, it is the Customer’s responsibility to confirm the rules governing the import and use of the products in the destination country. DocNutry has no control over the decisions of customs authorities or the fees they impose.
14. Data Protection and Cookies
14.1. Personal data is processed in accordance with the Privacy Policy.
14.2. The use of cookies and similar technologies is explained in the Cookie Policy.
15. Complaints
15.1. The Customer may file a complaint using DocNutry’s contact information.
15.2. The Electronic Complaints Book is also available.
16. Alternative Dispute Resolution
In the event of a dispute that does not concern the dispensing of medications or medical devices, nor the provision of pharmaceutical services, the consumer may turn to an Alternative Dispute Resolution (ADR) entity for consumer disputes.

17. Governing Law
17.1. These Terms and Conditions and the contracts entered into through DocNutry are governed by Portuguese law.
17.2. In the event of a dispute, the parties shall seek to reach an amicable resolution. If no agreement is reached, the matter shall be referred to the authority or court designated by the applicable laws, without prejudice to the consumer’s right to seek resolution through an alternative dispute resolution entity.
